These Terms & Conditions ("Terms") govern your access to and use of the website, products and services provided by Finishing Pointe. By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

"Client/User" means any person or business using our services. "Services" includes WhatsApp API integration, campaign management, digital marketing, creative services, and related offerings.

2. Eligibility & Registration

To access certain services, you may need to create an account and provide accurate, current and complete information. You must be at least 18 years old to use our services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Scope of Services

Finishing Pointe provides WhatsApp messaging services through WhatsApp Business API and other third-party providers. We will perform services as described in our proposals, invoices, or other agreements. Service delivery is subject to WhatsApp/Meta policies and third-party platform limitations.

5. Payment, Billing & Refunds

Fees for services will be set out in invoices, quotes or on our website. Unless otherwise stated, payments are due in advance. Refunds are discretionary and may be provided only according to the terms set out in a specific agreement. Credits for message units or API usage are non-refundable once consumed.

6. Intellectual Property

All content on our website, including text, graphics, logos, images and software, is the property of Finishing Pointe or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute or create derivative works without our prior written consent.

7. Confidentiality

Each party agrees to maintain the confidentiality of confidential information disclosed by the other party and to use such confidential information only for the purposes of performing obligations under these Terms.

8. Disclaimers & Limitation of Liability

We provide our services on an "as is" and "as available" basis. To the maximum extent permitted by law, Finishing Pointe disclaims all warranties, whether express or implied, including merchantability and fitness for a particular purpose.

In no event will Finishing Pointe be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with the services. Our cumulative liability for any claim arising out of or relating to these Terms will not exceed the total fees paid by you to Finishing Pointe in the 6 months preceding the claim.

9. Termination

We may suspend or terminate access to services for users who breach these Terms, for non-payment, or for any conduct we reasonably believe is harmful to our business or other users. Upon termination, outstanding fees remain payable.

10. Indemnification

You agree to indemnify, defend and hold harmless Finishing Pointe and its officers, directors, employees and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the services, your violation of these Terms, or your infringement of any rights of another.

11. Third-Party Services

Our services may rely on third-party providers (including Meta/WhatsApp, payment gateways, hosting providers and analytics services). Your use of those third-party services is also subject to their terms and policies. We are not responsible for their actions or failures.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

13. Changes to Terms

We may modify these Terms at any time. Updated Terms will be posted on our website with the "Last updated" date. Continued use of the services after changes constitutes acceptance of the revised Terms.
